Currently in Canada, a criminal code amendment from 1993 currently requires that HIV positive people disclose their status to sex partners prior to sexual contact, protected or otherwise, to avoid being charged with sexual assault for “fraud”.

Police didn’t need to shoot man in hospital gown: witness

“Vince said he is so disturbed by the events that he told the SIU that if he knew this would have turned out the way it did, he would not have called police.”The renovator who alerted police to Michael Eligon's presence points to the Milverton Blvd. window from which he asked Eligon, wandering in a hospital gown, if he was all right Friday morning. Minutes later, Eligon was shot dead by police.

What also bothers him is that after Eligon was shot three times at point-blank range, he said, the officers stomped on his prone body as he fell to the street.

“They were kicking him, stomping him. There was no need for that,” he said.

Then emergency workers began performing CPR.

Vince’s blood boils thinking about that. “So I am saying to myself, so you shoot him first and killed him, and now you’re trying to bring him back to life,” Vince said.

Pritchard said he saw a middle-aged man, about 5-foot-8 with dark hair and wearing a blue shirt that looked like a hospital gown. About five or six officers were behind the man trying to grab or restrain him and another two or three were in front, Pritchard said.

“And then I saw one officer raise his arm and fire at him point blank three shots,” said Pritchard, adding the shots were fired from about half a metre away.

Pritchard said that, as far as he could see, the man was not brandishing any weapons.

He fell to the pavement and police jumped on top of him, still trying to restrain him while his body was writhing, said Pritchard, adding the officers continued to restrain the man until his body stopped moving.

“My concern is, is this a man with mental health issues? From the time I came on the scene they had him surrounded with 11 police cars in total. I counted. There must have been 15 officers around this man in total,” said Pritchard.

“Was this an appropriate use of force in this situation? Was there a mental health team on site?”

People need to know the answers to these questions, he said.

life after life

I am having a difficult time continuing to post relevant news items, mostly as I do not have the time and have been worrying about friends who are struggling and need me now. It is hard to constantly feel like people are disappearing, and not knowing if they have commited suicide, died or been thrown back into prison. One friend, who is serving life on parole (and has been out of prison for 7 years) was recently thrown back in (over Christmas) for being depressed and not “getting better” fast enough in therapy. Now she has the threat of being returned to prison to serve the rest of her sentence (not on parole) if she doesn’t “recover” in 3 months. She is one of the kindest, most generous, funny people I know, but struggles immensely with life outside and her own sense of self-worth.

I haven’t heard from her in days and worry as to what has happened now.
